Terms of Service
These Terms govern your access to and use of Remorial.com, including public remorial pages, member accounts, creator tools, galleries, shared memories, subscriptions, and related services.

1. Agreement to These Terms
By accessing or using Remorial, you agree to these Terms of Service and to our Acceptable Use Policy. If you use Remorial on behalf of another person, family, organization, estate, or memorial committee, you represent that you have authority to accept these Terms for that use. If you do not agree, please do not use the service.
2. What Remorial Provides
Remorial provides tools for creating, managing, and sharing online memorial pages. A remorial may include profile details, life stories, dates and places, cemetery information, themes, photos, albums, and shared memories from invited or signed-in contributors.
Remorial is not a funeral home, cemetery, legal records service, estate planning service, grief counseling service, or emergency service. Content on Remorial is usually submitted by users, families, contributors, or administrators and may not be independently verified by Remorial.
3. Accounts and Eligibility
You are responsible for the accuracy of the information you provide and for keeping your login credentials secure. You are responsible for activity that happens under your account, including remorials, uploads, edits, approvals, and subscription activity.
You must be at least 13 years old to use Remorial. You must be at least 18 years old, or the age of majority where you live, to purchase a paid remorial plan or manage payment-related features. If you are under the age of majority, you may use Remorial only with permission from a parent or legal guardian.
4. Creating and Managing Remorials
When you create, edit, publish, password-protect, or manage a remorial, you represent that you have the rights, permissions, and family or personal authority needed to do so. Please use care when posting information about living people, minors, family relationships, medical details, addresses, service locations, or other sensitive information.
Public remorials may be viewed by anyone and may appear in search results, social previews, listings, or other public areas of Remorial. Private remorials are intended to be hidden from public listings and require a private share link or creator-provided password, but no online privacy control is absolute. Keep your own copies of important photos, stories, and records.
5. User Content
You keep ownership of photos, biographies, memories, captions, comments, names, dates, and other content that you submit to Remorial. By submitting content, you grant Remorial a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, transmit, back up, moderate, and otherwise use that content as needed to operate, protect, and improve the service.
You are responsible for the content you submit. You represent that you have the rights and permissions needed to submit it and that it does not violate the law, another person's rights, these Terms, or the Acceptable Use Policy.
Shared memories and memory photos may require approval before appearing publicly. Remorial, remorial creators, and authorized administrators may approve, edit, archive, unpublish, or remove content where appropriate.
6. Subscriptions, Billing, and Payments
During the beta release, creating and publishing remorials may be free through December 31, 2026. Some features may require a paid remorial plan after beta or when shown in the account area. Plan details, price, renewal period, and available features will be shown at checkout or in the account area. By starting a paid recurring plan or one-time purchase, you authorize the applicable charges, including recurring charges, taxes, and any payment processor fees disclosed at checkout.
Payments are processed by Stripe or another payment processor. Remorial does not store full card numbers or payment credentials. Your use of payment services may also be subject to the payment processor's terms and privacy practices.
Paid remorial purchases include a 15-day money-back guarantee. To request a refund, contact us within 15 days of the original purchase date with the account email and remorial details. Approved refunds are returned to the original payment method when available, and payment processor timing may vary.
You may cancel a subscription according to the cancellation tools made available in your account or by contacting us. Cancellation stops future renewals while allowing access through the end of the paid period. The 15-day money-back guarantee applies to paid remorial purchases unless stated otherwise at checkout or limited by law.
If Remorial removes, restricts, archives, unpublishes, deletes, or disables access to a paid remorial or related content under these Terms because of fraud, abuse, payment misuse, or policy violations, the 15-day money-back guarantee may not apply except where required by law.
7. Acceptable Use
You agree not to misuse Remorial or help anyone else misuse it. Prohibited conduct includes harassment, hate, threats, impersonation, infringement, scraping, spam, malware, unauthorized access, fraudulent activity, fabricated memorials, and other uses described in the Acceptable Use Policy.
8. Moderation and Enforcement
We may review, refuse, remove, restrict, archive, unpublish, or disable access to content or accounts if we believe they violate these Terms, the Acceptable Use Policy, another person's rights, or the spirit of a respectful memorial service. We may also take action to protect Remorial, users, families, contributors, payment systems, or the public.
To the fullest extent permitted by law, Remorial may refuse to publish, remove, delete, unpublish, archive, restrict, or disable any remorial for any reason, including if we determine in our discretion that the remorial or related activity is unacceptable, inappropriate for the service, inconsistent with our standards, harmful, disputed, incomplete, misleading, or otherwise not suitable for Remorial. Payment for a remorial plan does not guarantee that a remorial or any specific content will be published, remain published, or remain available indefinitely.
We are not required to monitor all content before it appears. If you believe content is unlawful, infringing, abusive, inaccurate, or posted without proper authority, please contact us with enough information to review the issue.
9. Remorial Intellectual Property
Remorial, Remorial.com, the site design, software, logos, graphics, and service features are owned by Remorial or its licensors and are protected by copyright, trademark, and other laws. These Terms do not give you ownership of Remorial's technology, branding, or content that is not yours.
10. Third-Party Services and Links
Remorial may include links, embedded tools, email services, payment processing, anti-spam tools, maps, hosting services, or other third-party services. We are not responsible for third-party services, websites, policies, availability, or content.
11. Service Availability and Data
We work to keep Remorial available and durable, but we do not guarantee uninterrupted access, permanent storage, error-free operation, or recovery of every item of content. Features may change, pause, or be discontinued. You should keep independent copies of content that matters to you.
12. Termination
You may stop using Remorial at any time. We may suspend or terminate access to all or part of the service if we believe you violated these Terms, created risk for others, failed to pay amounts due, or used the service in a way that may harm Remorial or others. After termination, some provisions of these Terms will continue to apply, including content licenses needed to maintain existing public pages, intellectual property rights, disclaimers, limitations of liability, and indemnity obligations.
13. Disclaimers
Remorial is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security. We do not guarantee that user-submitted content is accurate, complete, lawful, or appropriate.
14. Limitation of Liability
To the fullest extent permitted by law, Remorial will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, emotional distress, reputational harm, or business interruption arising from or related to your use of the service. To the fullest extent permitted by law, Remorial's total liability for any claim will be limited to the amount you paid to Remorial for the service in the 12 months before the claim, or 100 dollars if you paid nothing.
15. Indemnity
You agree to indemnify and hold Remorial harmless from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your content, your use of the service, your violation of these Terms, your violation of law, or your violation of another person's rights.
16. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new last updated date. Your continued use of Remorial after changes become effective means you accept the updated Terms.
17. Applicable Law
These Terms are intended to operate to the fullest extent permitted by applicable law. Nothing in these Terms limits rights that cannot be waived under the laws that apply to you.
